Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Forecourt platform (“Forecourt”, “the Service”, “we”, “us”, or “our”), operated by Forecourt (Pty) Ltd, registration number 2026/407708/07, a company registered in the Republic of South Africa.
By accessing or using the Service, you (“you”, “the Customer”) agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. The Service
Forecourt is a back-office automation platform for fuel station operators. The Service ingests end-of-day reports, automates accounting workflows, integrates with third-party accounting software (including Zoho Books), and provides reporting, reconciliation, and stock-management tools.
The Service is provided on a subscription basis, per fuel station site.
2. Accounts and access
To use the Service you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately of any unauthorised use of your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.
You may invite additional users to your organisation and assign them roles. You remain responsible for the actions of all users you grant access to.
3. Subscription and fees
Subscription fees are charged per fuel station site, per month, at the rate set out at the point of sign-up or in your service agreement. Fees are quoted in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated.
We may offer promotional or introductory pricing from time to time. Promotional terms will be set out at the point of sign-up and apply only for the stated period, after which standard pricing applies.
We reserve the right to revise our fees. We will give you at least 30 days’ notice of any fee change affecting your subscription. Continued use of the Service after a fee change takes effect constitutes acceptance of the revised fees.
4. Payment
Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. Payment is due on the invoice date. We may suspend or terminate access to the Service if payment is not received within the grace period stated on your invoice.
5. Payment processing
Card and electronic payments are processed by a third-party payment processor (Paystack). By subscribing, you authorise us and our payment processor to charge your selected payment method for the recurring subscription fees due, in South African Rand (ZAR), until you cancel in accordance with our Refund and Cancellation Policy.
Forecourt does not store your full card details. Card information is collected and processed directly by our payment processor, which maintains the relevant payment-industry security standards. We store only the billing records necessary to operate your subscription (such as invoices, amounts, and payment status).
If a recurring payment fails, we may retry the charge and may suspend the Service in accordance with clause 4 and our Refund and Cancellation Policy. You are responsible for keeping your payment method valid and funded.
6. Cancellation and refunds
Cancellation and refund terms are set out in our Refund and Cancellation Policy, which forms part of these Terms.
7. Third-party integrations
The Service integrates with third-party services, including Zoho Books and payment processors. Your use of those services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services, and we are not liable for any loss arising from their use, interruption, or failure.
You authorise Forecourt to access and exchange data with the third-party services you connect to your account, for the purpose of providing the Service.
8. Customer data and responsibilities
You retain ownership of the data you submit to the Service (“Customer Data”). You grant us a licence to process Customer Data solely for the purpose of providing and improving the Service, in accordance with our Privacy Policy.
You are responsible for:
- The accuracy and legality of the Customer Data you submit;
- Ensuring you have the right to submit that data to us;
- Verifying the output of the Service before relying on it for accounting, tax, or financial decisions.
The Service automates and assists with accounting workflows but does not constitute professional accounting, tax, or financial advice. You remain responsible for the accuracy of your financial records and for compliance with your tax and regulatory obligations.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Attempt to gain unauthorised access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse-engineer, copy, or resell the Service without our written permission.
We may suspend or terminate your access if you breach this clause.
10. Availability and support
We aim to provide a reliable Service but do not guarantee uninterrupted availability. The Service may be unavailable during maintenance, updates, or circumstances beyond our reasonable control.
Support is provided via the contact channels published on our website.
11. Limitation of liability
To the maximum extent permitted by law, Forecourt’s total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the three months preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Consumer Protection Act and the Electronic Communications and Transactions Act of South Africa.
12. Indemnity
You agree to indemnify and hold Forecourt harmless from any claims, losses, or damages arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
13. Termination
Either party may terminate the subscription in accordance with the Refund and Cancellation Policy. On termination, your access to the Service will cease. We will retain or delete your Customer Data in accordance with our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on our website and update the “Last updated” date. Material changes will be communicated to you. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or relating to these Terms is subject to the exclusive jurisdiction of the South African courts.
